I received this beauty with some cosmetic problems that the seller said must have occurred during shipping. He shipped it in its case without padding or boxing it.

 

I started two previous threads on this story and thought it was over. PayPal told me I had no buyer protection since I supplied the shipping label to the seller. They said that if I bought shipping with PayPal I would be eligible. They were sympathetic but the matter was closed. I had to eat the cost of repairing the binding and the wet sanding, nitro touch ups, and buffing.

 

For unclear reasons they reopened it this morning. It seems some of my supportive documents I had sent over a week ago were found and they are taking a new look.

 

After seeing this email I called and discussed the whole story with the rep. She made notes and read them back to me. She understands what happened.

 

Now it goes back to the judge.

 

Meanwhile Heritage has the guitar. If the seller decides to take it back, it will go back. If I lose the PayPal appeal or if the seller agrees to pay for the work, Jack will restore the guitar to like new.

 

I will update as the news rolls in.

I had seen in the original eBay listing that this is guaranteed by eBay, did you try them before paypal to resolve it?

 

I didn't see any details in eBay that excluded any shipper... and because you have no photos of those areas before shipping , for all you know it was that way before shipping.

I would claim that it is not as advertised.. but you must have something from him that states condition.. as his initial ad didn't really cover that.

I wouldn't claim "damaged in shipping" to eBay , instead that it's not in condition advertised.

 

... and after it's fixed, would you still want to send it back to him if that was the only option?

I tried eBay and PayPal. They are owned by the same company.

 

I did get a batch of photos taken just before I bid. These photos covered most of the guitar. In retrospect there were none of the part of the neck, the back or the part of the binding where the damage was though. That's suspicious. Both Aaron Cowles and Jack at Heritage believe that the damage likely occurred prior to shipment. The shipper told me by email that it was immaculate with no wear before I even bid on it. Those emails are now in the hands of PayPal.

 

I did claim that the condition is "significantly different from advertised in the listing." He claims this happened during shipping.

 

I'm asking the seller to either take the guitar back or pay for restoration.

 

It really is a beautiful guitar. Jack says he can get it to look like new. That would be a happy ending for me. But I'm okay sending it back without restoration if that's what the seller wants.

 

This whole thing has been an unintended adventure.

Most all wayward fleabay transactions are adventures...and not that kind that minstrels sing songs about.

 

I had my own mini-adventure with them this weekend.... I won't go into the boring details and/or risk a thread hijack... but will add that it is down right frustrating and nauseating trying to deal with Ebay or Paypal on anything.

The email with " immaculate, with no wear" from the seller should seal the deal.

The seller should be following HOC posts. He is aware that I have been posting on it.

 

Just because we are adversaries doesn't mean we have to be rude. I have kept him up to date of this rollercoaster ride since PayPal has been much more communicative with me than him.

Mark, your "credentials," attitude and approach are impeccable, not that that's a guarantee of anything, anymore. I hope this works out the way it should! Best of luck!
